1. INTRODUCTION
WEBAHN INC ("we," "us," "our") operates POTVUE (potvue.com) and is committed to protecting the privacy of all individuals who interact with our platform. This Privacy Policy explains how we collect, use, disclose, and safeguard information from:
- Platform Users (restaurant and food/beverage business owners who create accounts), and
- End Customer (individuals who view menus or subscribe to push notifications).
Please read this policy carefully. By using POTVUE, you consent to the practices described herein.
2. INFORMATION WE COLLECT
2.1 Information from Platform Users (Account Holders)
Account Information: Name, business name, email address, phone number, business address, and account credentials.
Business Information: Menu content, item descriptions, pricing, images, and other business data you upload or create.
Payment Information: Billing details processed through Stripe. We do not store full credit card numbers; payment data is handled directly by Stripe under their PCI-DSS compliant systems.
Usage Data: Log files, IP addresses, browser type, device information, pages visited, features used, and interaction timestamps.
Uploaded Files: Images and PDF documents uploaded for menu creation, including data extracted therefrom via AI processing.
Communications: Emails, support tickets, and other correspondence with our team.
2.2 Information from End Customers (Menu Viewers and Push Subscribers)
Viewing Data: IP address, device type, browser information, and general geographic location when a Menu QR code is scanned or a Menu is accessed.
Push Subscription Data: Browser-generated push notification tokens, device identifiers, and subscription preferences when an End Customer opts in to receive push notifications. We do not collect names or email addresses from End Customers unless voluntarily provided.
Interaction Data: Notification delivery and engagement data (e.g., whether a notification was received or clicked).
2.3 Automatically Collected Information
We use cookies, web beacons, and similar tracking technologies to collect information about how users interact with our Platform. See Section 8 for our Cookie Policy.
3. HOW WE USE YOUR INFORMATION
3.1 For Platform Users
- To create and manage your account;
- To provide, operate, and improve the Service;
- To process payments and manage billing;
- To generate and manage QR codes and published Menus;
- To perform AI-assisted data extraction from uploaded files;
- To moderate uploaded content;
- To send service-related communications, including billing notices, updates, and security alerts;
- To send marketing communications (with your consent, and subject to opt-out);
- To enforce our Terms of Service and legal obligations;
- To analyze usage patterns and improve platform performance;
- To comply with applicable laws and respond to legal requests.
3.2 For End Customers
- To deliver web push notifications on behalf of the Menu Owner to whom you have subscribed;
- To track notification delivery and engagement for reporting to Menu Owners;
- To analyze aggregate, anonymized usage patterns;
- To maintain the security and integrity of the Platform.
4. LEGAL BASIS FOR PROCESSING (GDPR AND APPLICABLE INTERNATIONAL LAW)
For users in the European Economic Area (EEA), United Kingdom, and other jurisdictions with similar requirements, we process personal data on the following legal bases:
- Contractual Necessity: Processing required to perform our contract with you (e.g., account management, service delivery, billing).
- Legitimate Interests: Processing for fraud prevention, security, platform improvement, and analytics, where not overridden by your rights.
- Consent: Processing for marketing communications and push notification delivery (which you may withdraw at any time).
- Legal Obligation: Processing required to comply with applicable laws.
5. INFORMATION SHARING AND DISCLOSURE
We do not sell your personal information. We may share information in the following circumstances:
5.1 Service Providers
We share information with trusted third-party vendors who assist in operating the Platform, including:
- Stripe, Inc. – payment processing;
- Cloud hosting and infrastructure providers – data storage and computing;
- Push notification service providers – delivery of web push notifications;
- AI/ML service providers – menu data extraction from uploaded files;
- Content moderation services – review of uploaded images;
- Analytics providers – platform usage analysis.
All service providers are contractually required to protect your information and use it only for the purposes for which it was shared.
5.2 Menu Owners and End Customers
Menu Owners can view aggregated push notification analytics related to their own Subscribers. Menu Owners do not receive personally identifiable information about individual End Customers beyond what is described in the Push Subscriber Agreement.
5.3 Legal Requirements
We may disclose information if required by law, court order, or governmental authority, or if we believe disclosure is necessary to protect the rights, property, or safety of WEBAHN INC, our users, or the public.
5.4 Business Transfers
In the event of a merger, acquisition, or sale of all or substantially all of WEBAHN INC's assets, your information may be transferred to the acquiring entity, subject to the same privacy protections.
5.5 With Your Consent
We may share information for other purposes with your explicit consent.
6. DATA RETENTION
- Account Data: Retained for the duration of your account and for up to 3 years after account closure for legal and business purposes.
- Payment Records: Retained as required by applicable tax and financial regulations (typically 7 years).
- Menu Content: Deleted within 90 days of account closure upon request.
- Push Subscription Data: Retained until a Subscriber unsubscribes or the associated Menu Owner account is closed.
- Usage Logs: Retained for up to 12 months.
7. YOUR PRIVACY RIGHTS
Depending on your jurisdiction, you may have the following rights:
- Access: Request a copy of the personal data we hold about you.
- Correction: Request correction of inaccurate or incomplete data.
- Deletion: Request deletion of your personal data, subject to legal retention requirements.
- Portability: Request your data in a structured, machine-readable format.
- Objection/Restriction: Object to or request restriction of certain processing activities.
- Withdraw Consent: Withdraw consent for consent-based processing at any time.

8. COOKIES AND TRACKING TECHNOLOGIES

We implement appropriate safeguards for international transfers, including Standard Contractual Clauses where required by applicable law.
10. CHILDREN'S PRIVACY
The Service is not directed to individuals under the age of 13 (or 16 in the EEA). We do not knowingly collect personal information from children. If we become aware that we have collected information from a child without parental consent, we will delete it promptly. 11. SECURITY
We implement industry-standard technical and organizational security measures to protect your information, including encryption in transit (TLS/SSL), access controls, and regular security assessments. TERMS OF SERVICE AGREEMENT
For Restaurant Owners and Food/Beverage Service Operators

1. INTRODUCTION AND ACCEPTANCE OF TERMS
Welcome to POTVUE ("Service"), a digital menu platform operated by WEBAHN INC, a Michigan corporation ("Company," "we," "us," or "our"), located at 26711 Southfield Road, Lathrup Village, Michigan, United States. POTVUE is accessible at potvue.com and through associated mobile and web applications.
By registering for an account, accessing, or using the POTVUE platform, you ("User," "Owner," "Restauranteur," or "you") agree to be bound by these Terms of Service ("Agreement"). If you are entering into this Agreement on behalf of a business entity, you represent that you have the legal authority to bind that entity to these terms. If you do not agree to these terms, do not use the Service.
This Agreement constitutes a legally binding contract between you and WEBAHN INC governing your use of the POTVUE platform and all related services.
2. DEFINITIONS
- "Platform" means the POTVUE website, software, tools, APIs, and all related services available at potvue.com.
- "User" or "Owner" means any individual or business entity that registers for a POTVUE account to create and manage digital menus.
- "Menu" means any digital food, beverage, or service listing created and published through the Platform.
- "End Customer" or "Subscriber" means any individual who views a published Menu or subscribes to push notifications from an Owner.
- "Content" means any text, images, data, information, or other material uploaded, submitted, or published through the Platform.
- "Subscription Plan" means the Free, Pro, or Premium service tier selected by the User.
- "Push Notification" means a web-based alert or message sent by an Owner to their Subscribers through the Platform.
- "QR Code" means the unique machine-readable code generated by the Platform linking to a User's published Menu.
- "AI Extraction" means the automated process by which the Platform uses artificial intelligence to extract menu data from uploaded images or PDF documents.
- "Stripe" means Stripe, Inc., the third-party payment processor used by the Company.
3. ACCOUNT REGISTRATION AND ELIGIBILITY
3.1 Eligibility
To use the Service, you must:- Be at least 18 years of age or the legal age of majority in your jurisdiction;
- Have the legal capacity to enter into binding contracts;
- Operate a legitimate food, beverage, or hospitality-related business;
- Not be located in a country subject to applicable U.S. government sanctions or embargoes, including but not limited to countries designated by the U.S. Office of Foreign Assets Control (OFAC);
- Not be a person or entity prohibited from receiving U.S. exports or listed on any U.S. government restricted-party list.
3.2 Account Creation
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at potvue@webahn.com of any unauthorized use of your account.3.3 One Account Per Business
Each business location or entity may maintain one account per Subscription Plan tier. The Company reserves the right to merge or terminate duplicate accounts.3.4 Account Verification
The Company reserves the right to verify the identity and legitimacy of any User and may request supporting documentation. Failure to provide requested verification may result in account suspension or termination.4. DESCRIPTION OF SERVICES
4.1 Core Features
POTVUE provides the following core services to registered Users:(a) Digital Menu Creation: Users may create digital menus manually by entering data, or by uploading image files or PDF documents from which menu data will be extracted using AI-assisted technology. Users acknowledge that AI extraction is automated and may not be 100% accurate, and that Users are solely responsible for reviewing, correcting, and approving all extracted content before publication.
(b) Menu Publication: Users may publish their Menus to be accessible by End Customers via a unique QR code generated by the Platform.
(c) Bilingual Menus: All plan tiers support menu creation in two languages. Pro and Premium plans support up to five (5) languages.
(d) Image Uploads: Users may upload images of menu items, subject to content moderation as described in Section 7.
(e) Push Notifications: Users may send web push notifications to End Customers who have subscribed to receive alerts from that User's Menu.
(f) QR Code Generation: The Platform generates a unique QR code for each published Menu.
4.2 Subscription Plans
4.3 Global Availability
The Service is available globally, except in countries subject to applicable U.S. sanctions or where use of the Service would violate local laws. Users are responsible for ensuring their use of the Service complies with all applicable local, national, and international laws and regulations.5. PAYMENT TERMS AND BILLING
5.1 Free Plan
The Free plan is provided at no cost and includes the features described on the pricing page. The Company reserves the right to modify Free plan features at any time with reasonable notice.5.2 Paid Plans
Pro and Premium plans are billed as monthly recurring subscriptions at the rates of $9.50 USD per month (Pro) and $19.50 USD per month (Premium), unless otherwise stated. Prices are in U.S. dollars and are subject to applicable taxes.5.3 Payment Processing
All payments are processed through Stripe, Inc. By subscribing to a paid plan, you agree to Stripe's Terms of Service and Privacy Policy, available at stripe.com. You authorize WEBAHN INC and Stripe to charge your designated payment method on a recurring monthly basis.5.4 Billing Cycle
Subscriptions begin on the date of initial payment and renew automatically each month on the same calendar date. If a billing date falls on a day that does not exist in a given month, billing will occur on the last day of that month.5.5 Failed Payments
If a payment fails, we will attempt to notify you via the email address on file. Access to paid features may be suspended until payment is successfully processed. After 7 days of failed payment, your account may be downgraded to the Free plan.5.6 Cancellation and Refunds
You may cancel your paid subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. WEBAHN INC does not provide refunds for partial months or unused portions of a subscription period, except where required by applicable law. Upon cancellation, your account will revert to the Free plan at the end of the paid period.5.7 Price Changes
The Company reserves the right to change subscription pricing with at least 30 days' written notice to the email address on file. Continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.5.8 Taxes
You are responsible for all applicable taxes, duties, and levies imposed by any governmental authority in connection with your use of the Service. The Company will collect taxes where legally required to do so.6. USER CONTENT AND INTELLECTUAL PROPERTY
6.1 Ownership of User Content
You retain all ownership rights to the Content you upload, create, or publish through the Platform, including menu text, images, and business information ("User Content"). By submitting User Content, you grant WEBAHN INC a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute your User Content solely for the purpose of providing and improving the Service.6.2 Representations Regarding Content
You represent and warrant that:- You own or have all necessary rights, licenses, and permissions to submit and publish your User Content;
- Your User Content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights;
- Your User Content is accurate and not misleading;
- Your User Content complies with all applicable laws and regulations, including food labeling and advertising laws.
6.3 POTVUE Intellectual Property
All rights, title, and interest in and to the POTVUE Platform, including its software, design, trademarks, logos, and proprietary technology (including AI extraction tools), are owned exclusively by WEBAHN INC. Nothing in this Agreement grants you any right to use WEBAHN INC's or POTVUE's trademarks, logos, or proprietary technology except as expressly permitted.6.4 Feedback
If you provide suggestions, feedback, or ideas regarding the Service, you grant WEBAHN INC a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation to you.7. CONTENT MODERATION AND ACCEPTABLE USE
7.1 Content Moderation
All images uploaded to the Platform are subject to automated and/or manual content moderation. The Company reserves the right to remove or reject any image or Content that, in its sole discretion, violates these terms or is otherwise inappropriate.7.2 Prohibited Content
You agree not to upload, publish, or transmit any Content that:- Is false, misleading, or deceptive;
- Infringes any intellectual property or proprietary rights;
- Contains nudity, sexually explicit material, or graphic violence;
- Promotes illegal activities, controlled substances, or unlicensed alcohol sales;
- Contains malware, viruses, or malicious code;
- Violates any applicable food safety, labeling, or advertising regulations;
- Harasses, defames, or discriminates against any individual or group;
- Violates any applicable local, national, or international law.
.3 Push Notification Standards
Push notifications sent through the Platform must:- Relate directly to your food/beverage business and menu offerings;
- Not constitute spam or unsolicited commercial messages beyond what Subscribers have consented to receive;
- Comply with all applicable anti-spam laws, including the U.S. CAN-SPAM Act and similar international regulations;
- Not contain misleading subject lines or deceptive content.
7.4 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with this Agreement. You agree not to:- Attempt to gain unauthorized access to any part of the Platform;
- Use automated tools to scrape, crawl, or extract data from the Platform without written permission;
- Interfere with or disrupt the integrity or performance of the Platform;
- Impersonate any person or entity or misrepresent your affiliation;
- Use the Service to compete with or reverse-engineer the Platform.
8. AI EXTRACTION DISCLAIMER
The AI-assisted menu data extraction feature is provided as a convenience tool. WEBAHN INC makes no representations or warranties regarding the accuracy, completeness, or reliability of data extracted from uploaded images or PDF documents. You are solely responsible for reviewing all AI-extracted content and correcting any errors before publishing your Menu. WEBAHN INC shall not be liable for any inaccuracies in published menus resulting from AI extraction errors.9. PRIVACY AND DATA
Your use of the Service is governed by our Privacy Policy, incorporated herein by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. With respect to your End Customers' data, you agree to comply with all applicable privacy laws and to maintain your own privacy policy governing your relationship with your End Customers.10. THIRD-PARTY SERVICES
The Platform integrates with third-party services including Stripe for payment processing. Your use of third-party services is governed by those parties' respective terms and privacy policies. WEBAHN INC is not responsible for the practices, availability, or content of any third-party services.11. SERVICE AVAILABILITY AND MODIFICATIONS
11.1 Uptime
The Company will use commercially reasonable efforts to maintain Service availability. However, the Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. The Company does not guarantee uninterrupted or error-free service.11.2 Modifications
The Company reserves the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. For material changes to paid plan features, the Company will provide at least 30 days' notice.11.3 Termination by Company
The Company may suspend or terminate your account immediately if you violate this Agreement, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately.11.4 Termination by User
You may terminate your account at any time by contacting potvue@webahn.com or through your account settings. Termination does not entitle you to a refund of any prepaid fees.11.5 Effect of Termination
Upon termination, the Company may delete your account data, including published Menus and Subscriber lists, after a reasonable retention period. Sections 6, 12, 13, 14, and 15 survive termination.12. DISCLAIMERS OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING. WEBAHN INC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEBAHN INC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL WEBAHN INC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO WEBAHN INC IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law.4. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless WEBAHN INC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of this Agreement; (d) your violation of any applicable law or regulation; (e) your relationship with your End Customers; or (f) any push notifications you send through the Platform.15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.15.2 Dispute Resolution
Any dispute arising out of or relating to this Agreement shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with proceedings conducted in Michigan. The arbitrator's decision shall be final and binding.15.3 Class Action Waiver
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST WEBAHN INC.15.4 Exceptions
Either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Michigan to prevent irreparable harm.16. GENERAL PROVISIONS
16.1 Entire Agreement
This Agreement, together with the Privacy Policy and any additional terms for specific features, constitutes the entire agreement between you and WEBAHN INC regarding the Service.16.2 Amendments
The Company may update this Agreement at any time. Material changes will be communicated via email or prominent notice on the Platform at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.16.3 Severability
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.16.4 Waiver
Failure to enforce any provision of this Agreement shall not constitute a waiver of future enforcement rights.16.5 Assignment
You may not assign your rights or obligations under this Agreement without prior written consent from WEBAHN INC. The Company may assign this Agreement in connection with a merger, acquisition, or sale of assets.16.6 Force Majeure
WEBAHN INC shall not be liable for delays or failures in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, internet outages, or third-party service failures.16.7 Contact
